Nakagawa Planning and Construction Co., Ltd. (hereinafter referred to as “the Company”) filed a petition for commencement of corporate rehabilitation proceedings with the Osaka District Court on October 9, 2025. Pursuant to the preservation management order issued by the court on the same date, I have been appointed as the preservation manager. Going forward, I, as the preservation manager, shall possess all authority concerning the management of the Company's business operations and the management and disposition of its assets. I hereby report this matter.
With the issuance of the preservation management order and the preservation disposition order, repayment of debts arising from causes existing as of October 8, 2025, is legally prohibited. Furthermore, due to the comprehensive prohibition order concerning compulsory execution issued simultaneously, initiating compulsory execution or similar proceedings against our company is prohibited, and all already initiated compulsory execution or similar proceedings must be suspended. We hereby report this matter accordingly.
Moving forward, under the supervision of the Osaka District Court, we will cooperate with the investigation conducted by Attorney Tomohiro Kitano, who was appointed as an investigation commissioner pursuant to the investigation order issued concurrently with the preservation management order. Simultaneously, we will commence procedures to solicit business sponsors and, together with our employees, make every effort to achieve the early business rehabilitation of our company. Please note that our ongoing business operations will continue unchanged. We sincerely appreciate your continued support.
We deeply apologize for the significant inconvenience this will cause to our creditors and all other stakeholders. However, we are determined to work together as one company to preserve our business value and pursue revitalization, thereby striving to improve the repayment rate for our creditors.
We sincerely request your understanding and cooperation with this rehabilitation procedure.
